This Privacy Policy describes how LMBHC LLC d/b/a Mythic Guitar Company ("Mythic," "we," "us," "our") collects, uses, discloses, and protects your personal information when you visit MythicGuitars.com, use any of our services, place an order, submit an instrument for repair or custom work, communicate with us, or interact with our marketing — including SMS, email, and online advertising (collectively, the "Services").

The Services are hosted and powered by Shopify. Information you submit through the Services is transmitted to and processed by Shopify and its infrastructure. Please review the Shopify Consumer Privacy Policy at privacy.shopify.com for information about how Shopify independently processes your data. Where there is a conflict between our Terms of Service and this Privacy Policy regarding the collection, processing, or disclosure of personal information, this Privacy Policy controls.

1. Personal Information We Collect

"Personal information" means information that identifies you or can reasonably be linked to you. It does not include anonymized or de-identified information. Depending on how you interact with us and which Services you use, we may collect the following categories:

Contact and Identity Information
Your name, email address, phone number, shipping address, and billing address.

Financial and Payment Information
Credit card, debit card, and financial account numbers; payment card details; transaction information; form of payment; and payment confirmation data. Payment data is processed by our third-party payment processors. We do not store full card numbers on our own systems.

Account Information
Username, password, security questions, account preferences, and settings.

Transaction and Order Information
Items viewed, added to cart, wishlisted, purchased, returned, or canceled; order history; repair history; custom build history; and all related invoice and service records.

Instrument and Service Information
Instrument details (make, model, serial number), repair notes, custom build specifications, service preferences, and any information you provide in connection with a repair, custom build, or manufacturing order.

Communications
All information you provide when you contact us — including emails, phone call notes, support tickets, and chat messages.

Device and Technical Information
IP address, browser type and version, operating system, device identifiers, pages visited, time spent on pages, referring URLs, and network connection information.

Usage and Behavioral Information
How you navigate and interact with the Services, items added to your cart (including abandoned carts), pages viewed, clicks, search queries, and other behavioral data collected through cookies and similar tracking technologies.

Marketing and Messaging Information
Email engagement data (opens, clicks, unsubscribes), SMS opt-in and opt-out status, advertising interaction data, and referral source.

Location Information
If you enable location features or interact with location-based Services, we may collect geographic data from your device to provide localized features such as regional promotions, nearby events, or shipping estimates. Location data is never shared with third parties without your consent.

User-Generated Content
Reviews, photos, testimonials, social media interactions, and any other content you submit to us or post through the Services.

  • From Shopify — as our ecommerce platform, Shopify collects and shares certain data about your use of the Services with us

  • From business and marketing partners — including advertising networks that help us reach relevant audiences

3. How We Use Your Information

We use personal information for the following purposes:

Providing and Operating the Services
To process orders, payments, and returns; fulfill custom and manufacturing builds; schedule and perform repairs; maintain your account; arrange shipping; send order and service confirmations; provide customer support; and perform our contractual obligations to you.

Personalizing Your Experience
To remember your preferences, recommend products relevant to your purchases and browsing activity, create a customized shopping experience, and improve the relevance of our communications to you.

Marketing and Advertising
To send marketing, promotional, and advertising communications by email, SMS, or postal mail; to show you targeted online advertisements on our Site and third-party platforms; and to run retargeting campaigns based on your prior interactions with us — where you have opted in or where permitted by applicable law.

SMS Abandoned Cart Notifications
We use cookies and tracking technologies to monitor items you add to your cart. If you leave items in your cart without completing a purchase, and you have opted in to SMS communications, that information may be used to trigger a cart reminder via text message. By opting in to SMS, you consent to receiving these automated abandoned cart reminders.

Security and Fraud Prevention
To authenticate your account and transactions, detect and prevent fraudulent, illegal, or malicious activity, protect the security of our systems, and safeguard the safety of our customers and the public.

Legal Compliance and Enforcement
To comply with applicable laws and regulations; respond to valid legal process, subpoenas, search warrants, or government requests; investigate potential violations of our Terms or policies; and protect or enforce our legal rights.

Business Improvement

With Shopify
The Services are hosted by Shopify. Information you submit through the Services is transmitted to and shared with Shopify as our platform provider. Shopify may also use data from your interactions with our store, combined with data from other Shopify merchants, to provide and improve Shopify's platform features. In those circumstances, Shopify is independently responsible for that processing. See privacy.shopify.com for details.

With Service Providers
We share information with trusted vendors and service providers who help us operate the Site and Services — including payment processors, shipping carriers, fulfillment providers, cloud storage services, IT management, customer support tools, analytics providers, and email and SMS delivery platforms. These providers are authorized to use your information only as necessary to provide services to us.

With Business and Marketing Partners
We may share information with advertising and marketing partners to show you relevant ads on our Site and other platforms. This may include sharing data for targeted advertising purposes. Depending on where you reside, you may have a right to opt out of this type of sharing (see Section 8).

At Your Direction
When you request or consent to sharing, such as when you use a social media login integration or request that we ship a product to a third party.

Within Our Corporate Group
With affiliates or entities within our corporate group for purposes consistent with this Policy.

SMS-Specific Restriction
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent records will not be shared with any third party under any circumstance.


5. Cookies, Tracking Technologies, and Targeted Advertising

We use cookies, tracking pixels, web beacons, and similar technologies for the following purposes:

  • Functional: Keeping your cart, session, login state, and preferences intact
  • Analytics: Understanding how visitors use the Site so we can improve it
  • Marketing and retargeting: Delivering relevant ads to people who have visited the Site, including abandoned cart tracking
  • Shopify platform features: Supporting personalized features enabled through Shopify's infrastructure

6. SMS Marketing and Text Messaging

By providing your phone number and completing our SMS opt-in process, you consent to receive text messages from Mythic Guitar Company at the number provided. This may include:

  • Order confirmations, shipping updates, and delivery notifications
  • Repair status and completion notices
  • Payment requests and appointment reminders
  • Abandoned cart reminders (if you opt in to SMS)
  • Promotional and marketing messages — only with your prior express written consent

Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies.

To opt out: Reply STOP to any message. For help, reply HELP or contact us at mythicguitarco@gmail.com. We honor all opt-out requests promptly and no later than required by applicable law and carrier rules.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent records will not be shared with any third party.


7. Data Security and Retention

Security: We implement reasonable administrative, technical, and physical safeguards to protect your personal information against unauthorized access, disclosure, alteration, and destruction. No system or method of data transmission is completely secure. We cannot guarantee absolute security, and you use the internet at your own risk. We recommend that you do not use unsecured channels to transmit sensitive or confidential information to us.

Retention: We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including maintaining your account, providing Services, fulfilling warranty and support obligations, meeting accounting and tax requirements, resolving disputes, and complying with applicable legal obligations. Right to Delete: You may request that we delete personal information we hold about you, subject to exceptions for legal obligations, security, and other permitted purposes.

Right to Portability: You may request a copy of certain personal information in a portable format.

Right to Opt Out of Sale, Sharing, or Targeted Advertising: Depending on your state, you may have the right to opt out of the sale or sharing of your personal information and opt out of targeted advertising based on your online activity. To exercise this right, contact us using the details below.

Right to Opt Out of Marketing Communications: You may opt out of promotional emails at any time by using the unsubscribe link in any marketing email or by contacting us. You may opt out of SMS marketing by replying STOP. Opting out of marketing does not affect transactional or service-related communications.

Texas Residents (TDPSA): Texas residents have rights under the Texas Data Privacy and Security Act effective July 1, 2024, including all rights listed above plus the right to appeal a denial of your request and the right to opt out of profiling that produces legal or similarly significant effects.

How to Submit a Request: Email mythicguitarco@gmail.com with the subject line "Privacy Request." We may verify your identity before processing your request. You may designate an authorized agent to act on your behalf, provided the agent submits proof of authorization and we can verify your identity.

Appeals: If we deny your request, you may appeal by emailing mythicguitarco@gmail.com with "Privacy Appeal" in the subject line. We will respond to appeals as required by applicable law.

Shopify-Processed Data: For personal information processed directly by Shopify in connection with the platform's own operations, exercise your rights at https://privacy.shopify.com.


9. Third-Party Websites and Links

The Site may contain links to third-party websites or platforms. We do not control, endorse, or take responsibility for the privacy practices, security, accuracy, or content of any third-party site. When you leave our Site, this Policy no longer applies. We encourage you to review the privacy policies of any third-party site you visit. Information you post in public or semi-public spaces — including third-party social media platforms — may be viewable by others without limitation.


10. Children

The Services are not directed to children under the age of 13 (or the applicable age of majority in your jurisdiction). We do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has provided us with personal information, please contact us and we will delete it promptly. As of the effective date of this Policy, we do not have actual knowledge that we sell or share personal information of individuals under 16 years of age.

We operate in the United States and your information may be transferred to, stored in, and processed in the United States or other countries where data protection laws may differ from those in your country. If you access the Services from outside the United States, you consent to the transfer and processing of your information in the United States.

For transfers from the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses or equivalent UK mechanisms, where applicable.
