Refund policy

Refund & Return Policy

Mythic Guitar Company | LMBHC LLC

Effective Date: Aug 2024

By purchasing any guitar, placing any custom order, or placing any manufacturing or OEM order with Mythic Guitar Company — whether through our website, by phone, by email, by invoice acceptance, or by deposit payment — you agree to this Policy in full. If you do not agree, do not place an order.

The Short Version

We build everything by hand in Austin, Texas. We stand behind our work. We do not do buyer's remorse refunds — not for guitars, not for custom builds, not for manufacturing orders. Read below for exactly what we cover, what we don't, and what happens if you try to go around this policy.

PART ONE — GUITARS PURCHASED FROM OUR WEBSITE OR IN PERSON

Applies to all guitars listed for sale on the Mythic Guitar Company website, including stock builds, catalog guitars, and guitars purchased through our webstore or at our shop.

What You Are Buying

Every guitar on our website is built by hand, in small batches, in Austin, Texas. No two are identical. That is the point.

When you buy a Mythic guitar, you are buying a handmade instrument with all the character, variation, and individuality that comes with it. You are not buying a factory-produced guitar with machine-perfect consistency. If that is what you need, a production guitar from a large manufacturer is probably a better fit for you, and we mean that sincerely.

By purchasing, you acknowledge that you understand and accept the handmade nature of our instruments and all that comes with it, as described in this Policy.

All Sales Are Final

Every guitar sale is final at the time of purchase. We do not accept returns, exchanges, or cancellations for any of the following:

  • Change of mind
  • Buyer's remorse
  • Deciding you prefer a different model after receiving the guitar
  • Tone, resonance, sustain, attack, or any acoustic or sonic characteristic
  • Feel, playability, action, neck profile feel, string tension impression, or ergonomic preference
  • Weight or balance perception
  • "It doesn't sound like I expected"
  • "It feels different than I imagined"
  • "It looks different in person than in photos" — within the natural variation described below
  • Wood grain, figure, flame, quilt, color, or any natural material character
  • Finding the same or similar guitar at a lower price elsewhere after purchase
  • Financial circumstances that change after purchase

No exceptions to the above. Contacting us, disputing the charge, or returning the guitar without authorization does not change this.

Natural Variation Is Not a Defect

Every Mythic guitar is built from natural materials processed and finished by human hands. The following variations are expected, normal, and are not defects:

Wood:

  • Grain pattern, direction, figure, flame, quilt, birdseye, and other natural wood character
  • Mineral streaks, pitch pockets, small knots within grade, and other naturally occurring wood features
  • Color variation between pieces of the same species — two boards from the same tree will not match perfectly
  • Weight variation between instruments of the same model — wood density varies by nature
  • Wood movement, micro-cracking, or finish checking caused by changes in humidity or temperature after delivery

Finish:

  • Color variation from photographs — screens display color differently; in-person color in different lighting conditions will look different than photos
  • Finish depth, sheen, and texture variation inherent to hand-applied and small-batch finishing processes
  • Color variation within standard finish-industry delta-E tolerances
  • Finish sinking, settling, or hazing as finish cures over time after delivery — this is normal and expected, particularly with nitrocellulose lacquer
  • Orange peel texture on gloss finishes at typical viewing distances
  • Minor finish imperfections visible only under direct bright light or magnification that do not affect playability or structural integrity

Hardware and Electronics:

  • Substitution of a specified hardware brand for an equivalent within the same tier and functional category when the original brand is unavailable or back-ordered — we will notify you when this occurs
  • Variation in hardware plating color, texture, and aging between production batches
  • Minor tuning drift on new strings as they stretch — this is normal for all guitars

Dimensions and Weight:

  • Dimensional variance within ±0.5mm on body and neck dimensions
  • Weight variation — a stated weight is a target, not a guarantee; wood density determines final weight

Tone and Playability:

  • We do not warrant tone, resonance, sustain, attack, or any acoustic characteristic. These are subjective and depend on strings, amplification, playing style, room acoustics, and countless other factors outside our control. No guitar sounds the same to every player.
  • Factory setup is a starting point. Guitars require ongoing setup adjustment as they acclimate to their environment. Setup drift after delivery is normal and expected.

The Three Situations Where We Will Act

There are exactly three circumstances in which we will provide a remedy after a guitar sale:

1. Manufacturing Defect — 60-Day Warranty

If your guitar has a genuine manufacturing defect in our workmanship or a failure of Builder-installed hardware caused by our installation, within 60 days of delivery, we will repair it, replace the affected component, or — only if repair and replacement are both commercially impossible — refund your purchase price. See the Warranty section below for full terms, coverage, exclusions, and the claim procedure.

2. Wrong Guitar Shipped

If the guitar delivered is materially different from the model and configuration you ordered — meaning we shipped the wrong guitar — contact us in writing with photographs within 7 days of delivery. We will, at our election, ship the correct guitar, correct the order, or refund your purchase price.

Variation within the tolerances described above is not a "wrong guitar." A different finish depth is not a wrong guitar. A different wood figure than shown in the listing photo is not a wrong guitar. "Wrong guitar" means we shipped a different model, a different configuration, or a different product than what was listed in your order.

3. Carrier Damage on Shipments We Arranged

If we arranged the shipping and the guitar arrived with damage caused in transit, contact us in writing with photographs within 7 days of delivery and cooperate with any carrier insurance claim. We will repair, replace, or refund at our election.

If you arranged your own shipping or carrier, carrier damage is not our responsibility after we tendered the guitar to your carrier.

What Happens If You Don't Notify Us in 7 Days

If you receive a guitar and do not contact us in writing within 7 calendar days of delivery with a specific, documented claim under the wrong-guitar or carrier-damage exceptions above, the sale is accepted as final. No claim under those exceptions may be raised after that window closes.

Warranty claims may be raised within 60 days of delivery per the Warranty section below, but only for manufacturing defects — not for shipping damage or wrong-item claims.

60-Day Limited Warranty — Website Guitars

What Is Covered

Every Mythic guitar sold through our website carries a 60-day limited warranty from the date of delivery. We warrant the guitar against:

  • Manufacturing defects in workmanship
  • Failure of Builder-installed hardware caused by our installation

That is the scope of the warranty. Nothing more.

What Is Not Covered

This warranty does not cover, and we have no obligation for:

  • Physical damage. Drops, impacts, dings, cracks, broken headstocks, finish damage, or any damage caused by mishandling, accidents, or abuse — by you, anyone you let play it, or any carrier you chose.
  • Humidity and climate damage. Guitars are wood. Wood moves with moisture. Cracking, checking, warping, neck shifting, finish crazing, or any other condition caused by storing or playing the guitar outside the recommended humidity range of 45–55% relative humidity is not covered. This is one of the most common causes of guitar damage and is entirely preventable. We are serious about this.
  • Third-party work. If anyone other than Mythic Guitar Company performs any setup, fret work, modification, repair, refinish, nut replacement, electronics installation, or any other work on the guitar after delivery, the warranty is void for any issue that could have been affected by that work.
  • Setup and adjustment. Action, intonation, neck relief, nut height, and general playability setup are not warranty items. Guitars need setup. Environment changes setup over time. We set up every guitar before it ships; setup drift after delivery is normal and your responsibility.
  • Fret wear, finish wear, and normal aging. Frets wear. Finish wears. Hardware oxidizes. Strings go dead. These are not defects.
  • Electronics noise. Hum, interference, and noise from environmental electrical sources is not a manufacturing defect.
  • Subjective dissatisfaction. Tone, resonance, feel, weight, balance, playability impression, and any other subjective characteristic are not warranty items.
  • Cosmetic variation within the natural variation tolerances described above.
  • Anything arising more than 60 days after delivery. No exceptions to this deadline.

What We Will Do

If your warranty claim is valid, we will — at our election — repair the defect, replace the affected component, or replace the guitar with a comparable unit. Replacement is not always possible for one-of-a-kind builds.

If repair and replacement are both genuinely impossible, we will refund what you paid.

The warranty is capped at the purchase price. We are not liable for the cost of gigs you missed, gear you had to rent, flights you booked, or any other costs beyond the guitar itself.

How to Make a Warranty Claim

  1. Email us within 60 days of delivery. Include your order information, a written description of the issue, and clear photographs or video.
  2. Do not send the guitar back without authorization. Unauthorized returns may be refused at your expense.
  3. If we need the guitar for inspection, we will tell you. If the warranty claim is verified, we cover the return shipping. If it is not a covered defect, you cover it.
  4. We will respond to warranty claims within 5 business days.

Modifications and Third-Party Work

Any modification, repair, or work performed on the guitar by anyone other than Mythic Guitar Company after delivery:

  • Voids the warranty for any issue that could have been affected by that work
  • Is entirely at your own risk
  • Releases Mythic Guitar Company from any liability for any condition arising from or related to that work
  • Does not entitle you to any remedy from us

This includes but is not limited to: fret leveling and crowning, refrets, nut replacement, saddle replacement, pickup swaps, wiring modifications, tremolo setup, tuner swaps, bridge adjustments, neck resets, finish repairs, and any other work by any luthier, tech, or yourself.

Care Requirements

By purchasing a Mythic guitar, you agree to follow these care requirements. Failure to do so voids warranty coverage for related damage:

  • Humidity: Keep the guitar in an environment between 45% and 55% relative humidity at all times. Use a quality case humidifier in dry climates. A $15 humidifier prevents thousands of dollars of damage.
  • Temperature: Never leave a guitar in a hot car, near a heat source, in direct sunlight for extended periods, or in freezing conditions. Temperature extremes damage wood, finish, and glue joints.
  • Storage: Store in a case or on a wall mount away from vents, radiators, and windows. Do not store in a garage, basement, or any space with uncontrolled humidity.
  • Strings: Loosen string tension significantly during shipping or extended storage periods.
  • Cleaning: Use only products appropriate for guitar finishes. Solvent-based cleaners will damage lacquer and other finishes. We are not responsible for finish damage caused by improper cleaning products.

PART TWO — CUSTOM ONE-OFF BUILD ORDERS

Applies to all bespoke, made-to-order custom instruments commissioned directly with Mythic Guitar Company.

No Refunds. Rework Only.

All payments made to Mythic Guitar Company for custom orders are non-refundable.

The exclusive remedy for any verified, objective non-conformity between a delivered guitar and its written specifications is rework — meaning we correct the specific issue at our shop, on our timeline, by our chosen method. We determine what rework is appropriate. We determine when it is complete.

A monetary refund is not available under any circumstance except one: Mythic Guitar Company permanently ceases business operations and is physically unable to perform any further rework. If we are still in business, rework is the remedy. Full stop.

This includes, without limitation:

  • Deposits — non-refundable in all events, including cancellation, non-delivery, or any other circumstance
  • Progress payments — non-refundable once work has commenced
  • Design fees — non-refundable once design work has commenced
  • Balance payments — non-refundable once the product has been delivered or tendered

What Qualifies for Rework

Rework is available only for objective, verifiable deviations from written specifications confirmed in writing by both parties before production began.

To qualify, all of the following must be true:

  • (a) The specification must have been stated in writing before production began. Verbal discussions, phone calls, text messages, and "I thought we agreed" recollections are not specifications.
  • (b) The deviation must be objectively measurable — a dimension verifiable with a tool, a component specified and absent, a finish color named and visibly different. Not a feeling.
  • (c) Written notice with photographs and/or measurements must be submitted within 7 calendar days of delivery. Claims after seven days are waived.
  • (d) The deviation must exceed standard manufacturing tolerances — dimensional variance within ±0.5mm, standard finish color delta-E variation, and natural material character are not deviations.

What Does Not Qualify for Anything

  • Tone, resonance, sustain, attack, or any acoustic or functional performance characteristic
  • Feel, weight, balance, neck profile impression, or playability preference
  • "Not what I imagined" or any expectation not reducible to a written specification
  • Wood grain, figure, flame, quilt, color variation, or any natural material character
  • Finish appearance variation in different lighting conditions
  • Conditions arising after delivery from handling, humidity, use, or third-party modification
  • Claims not submitted in writing within 7 days of delivery
  • Change of mind, change of plans, or changed financial circumstances

Rework Process

  • We will assess the claim within 14 business days of receipt.
  • We will determine, in our sole reasonable discretion, whether the claim is valid and what rework is required.
  • Rework is performed at our facility, on our timeline, by our chosen method.
  • You ship the product to us at your cost. Verified valid claims are reimbursed for documented shipping costs.
  • We have 60 days from receipt to complete rework. Multiple rework attempts are permitted.
  • Rework does not restart, extend, or create any warranty period.
  • Our determination of when rework is complete is final, subject only to objective verification against written specifications.

Acceptance

All rework rights are extinguished on the earliest of:

  • (a) 7 calendar days passing after delivery without written notice meeting the rework requirements above
  • (b) You or any third party modifying, repairing, refinishing, or installing any component into the product
  • (c) You selling, transferring, listing for sale, or otherwise distributing the product
  • (d) You using the product commercially in any manner

Once accepted, no rework claim may be made.

PART THREE — OEM, WHITE-LABEL, AND MANUFACTURING ORDERS

Applies to all manufacturing orders, production runs, OEM orders, white-label builds, and any order that is not a stock guitar listed on our website.

No Refunds. Rework Only.

All payments made to Mythic Guitar Company for manufacturing orders are non-refundable. This is not a negotiating position. It is a condition of doing business with us.

The exclusive remedy for any verified, objective non-conformity between a delivered product and its written specifications is rework — we correct the specific issue at our facility, on our timeline, by our chosen method.

  • Production payments — non-refundable once work has commenced
  • Design fees — non-refundable once design work has commenced
  • Balance payments — non-refundable once the product has been delivered or tendered

  • (c) Written notice with photographs and/or measurements must be submitted within 14 calendar days of delivery. Claims after 14 days are waived.
  • (d) The deviation must exceed standard manufacturing tolerances — dimensional variance within ±1% of a nominal dimension, standard finish color delta-E variation, and natural material character are not deviations.

  • Change of mind, change of business direction, or changed financial circumstances

Rework Process

  • We will assess the claim within 14 business days of receipt.

All rework rights are extinguished on the earliest of:

  • (c) You selling, transferring, listing for sale, shipping to an end customer, or otherwise distributing the product
  • (d) You using the product commercially in any manner

Once accepted, no rework claim may be made.

Design Files and CAD

We do not release design files, CAD files, CNC toolpaths, native source files, or any production data to any client under any circumstance unless a formal manufacturing agreement has been executed in writing and signed by both parties.

Placing an order, paying a deposit, paying in full, taking delivery of product, or any other action does not entitle any client to receive design files of any kind. The only path to design file access is a signed contract.

File Buyout Option

If a client wishes to purchase design files, the following terms apply without exception:

  • The buyout fee is two times (2×) the total labor invested in the design and production of the applicable product, as documented by Mythic Guitar Company's internal records. This fee is in addition to — not a credit against — all other amounts paid for design, prototyping, and production.
  • The buyout fee must be paid in full before any files are released.
  • Even upon full payment of the buyout fee, the only files released are STL files — non-editable, geometry-only exports of the final product shape. No native CAD source files, no parametric history, no sketch trees, no CNC toolpaths, no G-code, no work-holding fixture designs, no process documentation, and no production methods are included or available at any price.
  • All other intellectual property of Mythic Guitar Company — including but not limited to native CAD files, CAM programs, toolpaths, fixturing, production sequences, and trade secrets — remains the exclusive property of Mythic Guitar Company and is never transferred, licensed, or disclosed to any client.
  • STL files released under a buyout are for the purchasing client's use only and may not be transferred, sublicensed, or provided to any third-party manufacturer without prior written consent from Mythic Guitar Company.

If you need editable native design files for any purpose, do not place an order with us expecting to obtain them. They are not available.

PART FOUR — TERMS THAT APPLY TO EVERYONE

Intellectual Property and Design Clearance

We reserve the right to cancel any order, at any time and without refund, if we determine or reasonably believe that a customer is submitting a design that is a knowing copy of, or is substantially based on, the protected intellectual property of another manufacturer or brand — including but not limited to registered trademarks, trade dress, headstock shapes, body shapes, logos, model names, or any other protected design elements — without documented written permission from the original rights holder.

This applies to all order types: website purchases, custom builds, and manufacturing orders. Payment of a deposit or any other amount does not obligate us to manufacture a product we believe to be infringing. No refund will be issued in the event of cancellation under this provision.

We are not lawyers. We do not provide legal advice. We cannot tell you whether your design is legally clear for manufacture, sale, or distribution — and we will not attempt to do so. Asking us whether a design is "close enough," whether it is "too similar," or whether you need permission is not something we can answer and is not something we will answer. We are not the appropriate party to make that determination.

It is entirely your responsibility to:

  • Conduct your own due diligence on any design you submit to us
  • Determine independently whether your design is clear of third-party trademark, trade dress, copyright, or patent rights
  • Obtain written permission from any rights holder whose protected property your design resembles, references, or is based upon, before submitting that design to us
  • Retain documentation of that permission and provide it to us upon request

By submitting any design to Mythic Guitar Company for custom build or manufacturing, you represent and warrant that you have the legal right to have that design manufactured, that it does not infringe any third party's intellectual property rights, and that you have obtained all necessary permissions. If that representation turns out to be false, you are solely responsible for all resulting liability — including any claims made against Mythic Guitar Company as a result of manufacturing your design.

60-Day Limited Warranty — All Products

Every Mythic guitar and manufactured product carries a 60-day limited warranty from the date of delivery, covering manufacturing defects in our workmanship and failure of Builder-installed hardware caused by our installation. That is the full scope. Nothing more.

Not covered:

  • Drops, impacts, dings, cracks, broken headstocks, or any damage caused by mishandling or accidents
  • Humidity and climate damage — any condition caused by storing or using the product outside the recommended range of 45–55% relative humidity is not covered. This is the most common cause of guitar damage and is entirely preventable
  • Any work performed on the product by anyone other than Mythic Guitar Company after delivery — including setups, fret leveling, refrets, nut replacement, pickup swaps, wiring, bridge adjustments, refinishing, or any other work by any luthier, tech, or yourself. If anyone other than us touches it, the warranty is void for any issue that could have been affected by that work
  • Action, intonation, neck relief, and playability setup — guitars need setup, environment changes setup, setup drift after delivery is normal and your responsibility
  • Fret wear, finish wear, hardware oxidation, and normal aging
  • Electronics hum or noise from environmental electrical sources
  • Subjective dissatisfaction with tone, feel, weight, balance, or playability
  • Any condition arising more than 60 days after delivery — no exceptions

The remedy: We repair it, replace the affected component, or — only if both are genuinely impossible — refund what you paid for that specific product. That is the ceiling. We are not liable for missed gigs, equipment you rented, flights you booked, recording sessions you postponed, or any other costs beyond the price of the product itself.

How to make a warranty claim:

  1. Email us within 60 days of delivery with your order information, a written description of the issue, and clear photographs or video.
  2. Do not send anything back without authorization. Unauthorized returns may be refused at your expense.
  3. If we need the product for inspection, we will tell you. If the warranty claim is verified, we cover return shipping. If it is not a covered defect, you cover it.
  4. We will respond to warranty claims within 5 business days.

Chargebacks and Payment Disputes

By placing any order or making any payment to Mythic Guitar Company, you agree not to initiate any chargeback, payment reversal, or payment dispute through any bank, card network, or payment processor that is inconsistent with this Policy. Doing so constitutes a breach and triggers liquidated damages of US $500.00 per occurrence, plus all costs we incur responding — including processor fees, administrative time, and attorneys' fees — regardless of how the chargeback is ultimately resolved.

Contact us before involving your bank. We are easier to deal with than a collections process.

Limitation of Liability

Our total liability for any claim is capped at the amount you actually paid us for the specific product at issue.

We are not liable under any circumstances for:

  • Lost profits, lost revenue, or lost business opportunities
  • Damage to your reputation, brand, or customer relationships
  • Delays in your schedule, commitments, or product launches
  • Missed performances, bookings, sessions, or engagements
  • Any consequential, special, incidental, indirect, exemplary, or punitive damages

This applies even if we were advised such damages were possible.

Dispute Resolution

Contact First. Before filing for arbitration, you must contact us in writing, describe the issue specifically, and give us 30 days to respond and attempt resolution.

Binding Arbitration. All disputes arising out of or relating to any purchase, order, or this Policy — including disputes about the validity or scope of this Policy — shall be resolved exclusively by binding arbitration administered by the American Arbitration Association, seated in Travis County, Texas, before a single arbitrator, applying Texas law. The award is final and enforceable as a court judgment.

No Class Actions. You waive any right to participate in any class action, collective action, mass action, or representative proceeding. All claims must be brought individually.

No Jury Trial. For any matter that proceeds in court, you irrevocably waive the right to a jury trial.

Prevailing Party Fees. The prevailing party in any arbitration recovers reasonable attorneys' fees and arbitration costs from the other party.

Governing Law

Texas law governs. The UN Convention on Contracts for the International Sale of Goods does not apply.

General

  • Entire Agreement. This Policy, together with any written order confirmation or invoice, is the entire agreement between you and Mythic Guitar Company regarding refunds, returns, and remedies, and supersedes all prior discussions.
  • No Oral Modifications. Changes to this Policy require written agreement signed by an authorized representative of Mythic Guitar Company.
  • Severability. Unenforceable provisions are reformed to the minimum extent necessary, not struck.
  • No Waiver. Failure to enforce any provision is not a waiver.
  • Signed Agreements Control. If you have executed a separate signed manufacturing, services, or purchase agreement with Mythic Guitar Company covering your order, that signed agreement controls over this Policy in any conflict.
